1.前言 preamble

一份標(biāo)準(zhǔn)英文合同通?？梢苑譃榍把裕╬reamble）、正文（operative part）、附錄（schedule）及證明部分即結(jié)束詞（attestation）四大部分組成。 前言（preamble）由“parties”及“recitals”兩部分組成。

“parties”為必備條款，在很多時(shí)候稱為“commencement”即合同的開(kāi)場(chǎng)白，主要介紹合同各方的名稱或姓名、注冊(cè)地及地址、郵編及在合同中的簡(jiǎn)稱。當(dāng)然，并不是所有的合同都要詳細(xì)介紹以上諸要素，在許多簡(jiǎn)單合同中，只是提一下各方的名稱。

i. 以下為“parties”的常用表達(dá)方式：

i. 常見(jiàn)的定義語(yǔ)句常用mean, refer to, be construed as, include等來(lái)表達(dá)。如：

1. "territory" means the united states of america.“銷售地區(qū)”是指美利堅(jiān)合眾國(guó)。

2. “commencement date” shall mean the date of signing this agreement by the last signing party hereto.

3. the “agreement” herein referred to shall mean this agreement of agency by entrustment.

五十年代的漢語(yǔ)拼音對(duì)于中國(guó)的漢字的普及、文化的普及做出了巨大的貢獻(xiàn)，有了拼音大家讀音統(tǒng)一，然后開(kāi)始認(rèn)字，開(kāi)始識(shí)字，開(kāi)始寫字，到現(xiàn)在這樣的貢獻(xiàn)有沒(méi)有負(fù)面的問(wèn)題？我們今天看到的所有的孩子學(xué)完漢語(yǔ)拼音以后，他就用漢語(yǔ)拼音認(rèn)識(shí)了漢字。漢字最早的第一個(gè)進(jìn)入到你記憶里邊的一個(gè)要素是abcd的字母，而不是點(diǎn)橫撇捺的筆順。大家覺(jué)得漢字遺傳幾千年，幾百代傳下來(lái)的遺傳密碼會(huì)不會(huì)在幾代人里面消失掉？有沒(méi)有可能？你現(xiàn)在認(rèn)識(shí)漢字只是結(jié)果是漢字而已，你所有的構(gòu)成的過(guò)程，你對(duì)它的逐漸推進(jìn)的認(rèn)知過(guò)程全部都是拼音，全部都是英文字母。

我們可以用幾個(gè)字來(lái)舉一個(gè)例子，來(lái)向大家解釋一下漢字之美。

好，這個(gè)是一個(gè)古代的“臺(tái)”字，大家看這個(gè)臺(tái)字像不像一個(gè)寶塔？一個(gè)漢字，上面是一個(gè)土，然后中間這個(gè)部分有房梁，有屋檐，下面有柱子，有下面的地基，這樣的字它僅僅是一個(gè)符號(hào)嗎？不是，你從這個(gè)字里面你就能看到我們中國(guó)古代人在造字的時(shí)候他的那種意匠，這個(gè)是漢代，寫的。好，再走第二個(gè)，這個(gè)是唐代歐陽(yáng)詢的九成宮的臺(tái)字，四方。大家有沒(méi)有發(fā)現(xiàn)用毛筆在寫的時(shí)候，中間這個(gè)口字是左邊虛右邊實(shí)，右邊那個(gè)轉(zhuǎn)折筆畫(huà)會(huì)非常粗，讓它變成一個(gè)非?！爸鴮?shí)”的這么一個(gè)印象，然后這個(gè)橫筆它會(huì)比較細(xì)，因?yàn)槭痰男Ч?，然后把左右兩邊的“門窗”給關(guān)嚴(yán)，有沒(méi)有這個(gè)感覺(jué)，中間的中軸線非常地挺拔，你在這里邊能看到健康、挺拔、穩(wěn)重，你都能找到這樣的感覺(jué)。再看第三個(gè)，這是一個(gè)鋼筆字，這已經(jīng)是隨便手寫的，它給我們的傳遞的審美信息已經(jīng)開(kāi)始弱化。再看第四個(gè)，因?yàn)橐?jiǎn)便，我們就慢慢地開(kāi)始把它原有的豐富的遺傳基因給流失掉了。

再看第五個(gè)，人的因素還有沒(méi)有了？都是機(jī)械線。再看第六個(gè)，文化背景被抽掉了，沒(méi)了。你覺(jué)得這樣的臺(tái)字對(duì)一個(gè)年輕的孩子來(lái)說(shuō)，他要學(xué)習(xí)中國(guó)的傳統(tǒng)文化，你覺(jué)得這樣的一個(gè)方式他能夠培養(yǎng)起對(duì)漢字的認(rèn)知嗎？

大家想一想，古埃及文化是怎么消滅的？就是因?yàn)榉奖恪Ｖ袊?guó)的傳統(tǒng)文化之所以到今天為止還是燦爛輝煌，其中有個(gè)很重要的要素就是漢字不滅，書(shū)寫筆順、筆劃的不滅。對(duì)你們來(lái)說(shuō)，其實(shí)拼音代表的就是一個(gè)西方文化，我們不是說(shuō)拒絕西方文化，你可以選擇拼音，但是你有沒(méi)有一個(gè)對(duì)漢字筆劃構(gòu)成的一個(gè)認(rèn)真地關(guān)注，甚至對(duì)它表示敬畏？這是老祖宗多少代人傳下來(lái)的。當(dāng)寫字成為我們大家的慢慢地再重新恢復(fù)這個(gè)傳統(tǒng)以后，我們就要開(kāi)始研究漢字作為一個(gè)文化的承傳，它非常重要，但是同時(shí)，漢字里面還天然地?cái)y帶美的基因。那么這個(gè)美的基因里面它還有很多的國(guó)學(xué)的倫理方面的一些要素。

第二組例子，我們就找了這個(gè)“信”，人言為信，人無(wú)信不立，孔夫子說(shuō)的。所以這個(gè)字背后是有強(qiáng)大的中國(guó)儒家文化的國(guó)學(xué)的一個(gè)意義在里面。

第一個(gè)信字，睡虎地秦簡(jiǎn)的這個(gè)信字，這個(gè)信字下面的口很大，所有的字都擠到一起，因?yàn)檫@個(gè)竹簡(jiǎn)的簡(jiǎn)的幅寬可能很窄，所以它就全擠在一起，武威漢簡(jiǎn)是在西北，這個(gè)時(shí)候的毛筆一看它的靈敏度就很高，所以它寫的是比較疏朗，它是松開(kāi)了。還有第三個(gè)是馬王堆的帛書(shū)，它是在絹帛上，織物它比較粗，所以它那個(gè)筆畫(huà)老是在上面有斑斑駁駁，但是這個(gè)字的寫法是一個(gè)帛書(shū)的寫法。第四個(gè)信字，在這里邊最好看，你看第二筆的橫筆，簡(jiǎn)直像一個(gè)舞蹈，像一個(gè)袖子的一個(gè)飄動(dòng)，上下三橫和一個(gè)口縮得很緊，形成一個(gè)疏和密之間的交叉，疏和密，寬和窄的交叉。而第五個(gè)信字，就是一個(gè)非常淳樸的一個(gè)規(guī)范。所以在這里面你能看到人，你能說(shuō)這個(gè)人很莊重，那個(gè)人很厚重，某一個(gè)人非常地飄逸，你能在這里面追加進(jìn)去各種各樣你的想法，因?yàn)樗膱D像給你這樣的一個(gè)意識(shí)，但是到了印刷體就沒(méi)有了，到了這樣更是連字都沒(méi)有。

通過(guò)這些范字我們要講的是什么？你要知道書(shū)法的魅力和寫字還不一樣，它們互相之間血肉相連。沒(méi)有漢字，沒(méi)有毛筆字，就沒(méi)有書(shū)法，這是可以肯定的，但是書(shū)法又不僅僅是寫毛筆字，書(shū)法是一個(gè)表達(dá)，一個(gè)傾訴，一個(gè)傳遞我們審美的感覺(jué)。我們經(jīng)常跟學(xué)生說(shuō)，某一筆，你看看這一筆是不是？它挑出去的時(shí)候那個(gè)感覺(jué)，是吧？有沒(méi)有看過(guò)京劇演員是怎么揮手的，怎么在舞馬鞭的，他是怎么在表達(dá)的。每一個(gè)人的表達(dá)不一樣，你的表達(dá)為什么一樣？很多情況下，我們?cè)趯憰?shū)法的時(shí)候，看書(shū)法的時(shí)候，是看字不是字，我們把它當(dāng)作一個(gè)很美的造型，很漂亮的一段舞蹈，很好的一段樂(lè)章，每一筆線條都是我們欣賞的一個(gè)非常重要的切入口。
